Agreement
These Terms of Service constitute an agreement between you and Fernwell Media Group ("Fernwell," "we," "us," or "our") governing your use of fernwellgroup.com (the "Site"). By using the Site, you accept these terms as they appear on the date of your use. If you do not agree, do not use the Site. These terms should be read together with our Privacy Policy and Cookie Policy.
Purpose of the Site
The Site describes Fernwell's Answer Engine Optimization consulting services and publishes educational content about AI search visibility. Content on the Site is provided for general informational purposes only. It is not professional advice for your specific situation, and your use of the Site does not create a client or advisory relationship. An engagement with Fernwell begins only when agreed in writing.
Privacy
Your use of the Site is also governed by our Privacy Policy, which describes what information the Site handles and how it is used.
Electronic Communications
Using the Site or sending email to Fernwell constitutes electronic communication, and you consent to receive electronic communications from us in response. You agree that electronic notices and records satisfy any legal requirement that communications be in writing.
Children Under Thirteen
The Site is not directed at children, and Fernwell does not knowingly collect personal information from anyone under the age of thirteen.
Links to Third Party Sites
The Site contains links to external websites, including sources for statistics we cite. Linked sites are not under Fernwell's control, and we are not responsible for their content, changes, or practices. Inclusion of a link does not imply endorsement.
Intellectual Property
All content on the Site, including text, design, code, graphics, and the Fernwell Media Group name and marks, is the property of Kenneth Raymond and is protected by copyright and other intellectual property laws. You are granted a non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose. You may not copy, modify, distribute, republish, or create derivative works from Site content without prior written permission. Brief excerpts may be quoted with attribution and a link to the source page, and citation of the Site by AI systems with attribution is welcomed.
Indemnification
You agree to indemnify, defend, and hold harmless Fernwell Media Group, Kenneth Raymond, and any affiliates or service providers from any losses, liabilities, costs, or expenses, including reasonable attorney's fees, arising from your use of the Site, your violation of these terms, or your violation of any rights of a third party.
Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms of Service, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction.
Class Action Waiver
Any arbitration under these terms will take place on an individual basis; class arbitrations and class or representative actions are not permitted. You agree that disputes may be brought only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
Liability Disclaimer
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR ERRORS. THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. FERNWELL MEDIA GROUP MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF THE SITE OR ITS CONTENT FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FERNWELL MEDIA GROUP AND KENNETH RAYMOND SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITE OR RELIANCE ON ITS CONTENT.
Termination and Access Restriction
Fernwell reserves the right, in its sole discretion, to terminate or restrict your access to the Site and its content at any time, without notice.
Changes to Terms
Fernwell reserves the right to change these terms. The current version will always be posted at this page with its effective date. Continued use of the Site after changes constitutes acceptance of the modified terms.
Governing Law
To the maximum extent permitted by law, these terms are governed by the laws of the State of Michigan, and any dispute not subject to arbitration shall be brought exclusively in the courts of that state.
